Privacy and Data Protection Luncheon (Toronto Sept. 27th): GDPR, new breach notification and consent requirements

BLG is organizing a privacy luncheon on September 27th in Toronto. Privacy and data protection continue to be top business and legal risks for Canadian organizations. Recent legal developments impose significant new restrictions and requirements for the handling of personal information, and expose Canadian organizations to potentially substantial risks and liabilities. I will be presenting with my partners Elisa Henry and Bradley Freedman on the following topics:

  • PIPEDA’s new security breach obligations impose reporting, notification and record-keeping obligations on Canadian organizations that suffer a breach of personal information security safeguards.
  • New consent guidelines issued by the Privacy Commissioners of Canada, British Columbia and Alberta outline additional requirements (including form and substance requirements for privacy policies and related notifications) so that organizations obtain individual’s meaningful consent to the collection, use and disclosure of their personal information.
  • The European Union’s General Data Protection Regulation (GDPR) imposes stringent personal data handling requirements, with potentially significant fines for non-compliance, on Canadian organizations that have an establishment in the EU or that collect or process EU residents’ personal data in connection with business activities or to monitor their behaviour.
